The old system was somewhat unfair but fine.

The current system is super fucked up but fixed some of the unfairness and can make things interesting. Nobody would know Livvy Dunne if not for NIL.

The future system - assuming this student = employee thing holds - will be more fucked up than interesting.

default position should be to take the side of the employee

The student athlete, at every level, gives more to the school than it could ever receive. The school is taking far more than just time. There are people plugging away in D III putting in 40+ hours per week.

From D3 up why do the players play then? There must be something in it for them other than education and camaraderie? Hell some d2 and all d3 do not even get scholarships.

DIII sports is basically a club sport.

What you said is true at the D1 level in basketball and football.

The non-revenue sports participants at every level are mostly overpaid even with just a scholarship and a place to live.

Most D3 schools would close with out athletes paying tuition.
