Prepare yourselves, Bernstein and Goff are going to HAVE to talk about the comments former Bears QB made to midday show Spiegel and Parkins regarding NFL players, as Orton put it, "protesting" the national anthem, police, and the flag.

Strap yourselves in, boys, Cubs playoff baseball and Mitchell (Pro Bowl QB) Trubisky can wait, it's yokel-ripping time on Bernstein and Goff.

We got a mention of lawyers for the Bernsie bingo card, but I was a bit disappointed he didn't quote a latin phrase when talking about the law. I guess "tortious" will do.

I was expecting "my wife has extensive experience in the Chicago hospitality sphere. She knows where the mold is and where the mold isn't and operates her business accordingly, and she told me that the...the hotel where the Nationals stayed? The HVAC there is immaculate."

Bernstein is such a dumb ass. There was nothing tortious or slanderous about what he said. The number one defense against slander is The Truth. Dusty didn't specify what kind of mold. There are thousands of different kinds of molds out there. No smart plaintiff attorney would pursue that against Dusty. They would have to prove there was not one trace of mold in the entire hotel for that statement of Dusty's to be tortious.

Wouldn't the hotel also have to prove they were damaged by Dusty's comments? Does Illinois still use defamation per se, and could such a claim (mold in a hotel) be deemed such?

Not sure on the exact Illinois laws behind defamation, but yes, the hotel would have to prove they were damaged by his comments. And a good defense attorney, which Dusty could afford, could pick apart any such allegations.

Defamation is a very hard thing to prove for large corporate entities. Same goes with famous people. The burden of proof to commit defamation against famous people and companies is very hard to reach. You can thank Hustler Magazine for that winning a landmark free speech case against Jerry Falwell.

Yeah whoever told him that such a thing might be actionable probably also said that Dusty would have had to at least named the hotel chain. And Dan, knowing Dusty didn't do that, came up with "well it's no secret where they stay, I mean we know, so...."
