He did. I don't think that was him minimizing what happened as much as it was him clarifying. He pretty much had to include that in order for him to say he learned later that being more famous and powerful means their consent wasn't what consent normally is, etc.

And as we hear more and more about Mr. Weinstein, it’s important to remember that while his behavior was appalling, it’s far too common.

That’s what Gretchen Carlson addresses in a New York Times op-ed she authored. This is only one part of the solution, and it’s unclear what, if any, role arbitration clauses played in Mr. Weinstein’s case. But it’s critical that we address this issue. Gretchen Carlson ends her piece with this: “I’m hopeful that the Weinstein story will represent the start of a sea change in our society’s treatment of sexually harassed workers. By ending arbitration clauses, blacklisting and workplace cultures where abuse thrives, we can ensure that victims of harassment speak out. I encourage victims to stand up and tell their stories, which I know requires immense bravery. And I’m hopeful that we’ll see changes in our laws and our culture that will allow them to do so without being victimized yet again.” I couldn’t agree more.

Almost everyone on the left is criticizing him. Unlike the other side, who used Joseph and Mary to say that Roy Moore as all good.

Eh, to be fair, most of the mainstream right did criticize Moore. Some wacky people like Hannity and other "Christian" righties don't constitute everyone on the right. A lot of liberals over on Jezebel and other liberal rags are saying Franken's accusers should not be trusted because she is a Hannity bot, etc. That doesn't mean most of the mainstream left isn't attacking him.

He did more than that though. Franken groped a girl who was asleep. He also wrote a "skit" in which he was to kiss her, harassed her into repeatedly rehearsing the kiss scene, then jammed his tongue down her throat. She had to shove him away from her.

I don't think the throw-in line about always asking was meant to shield him from criminal charges, I think it was in the hopes that they MIGHT shield him from civil action.

Outside of a few select areas (children, elderly, handicapped, etc.) and professions (healthcare provider, law enforcement, etc.) the law treats consent as consent, no matter the fame of either party.
