This shooting happened relatively close to my house last night (about a mile away) in Wheaton. The pub is located on a stretch of road across from the marshes down from the Wheaton Sports Center and Cosley Zoo. I've been there on occasion. You wouldn't expect a shooting there. Wheaton is a pretty dry place with Wheaton College in town.

Geez, he fired 11 times. Unbelievable.

I didn't realize Wheaton had Gay bars.

He fired warning shots, but the guy had not attacked the shooter initially or even after the warning shots.
Wonder how that works in terms of law of self-defense. I imagine it covers like a family member being attacked in your presence, but a buddy at a bar? Probably highly situation specific, was the guy doing the attacking at a physical advantage over the people being attacked etc. Although does sound like the shooter and buddies had a numbers advantage. So I dunno.

The shooter was d-bag for pulling a gun but doesn't sound like a clear 1st degree murder case.

Tho 11 shots can play either way, overkill for a self-defense claim vs I was in an overly excited state and didn't know what i was doing, which could knock it down from 1st degree.

Prosecutors always overcharge in anticipation of plea deals, of course. If they start off with 2nd degree you're quickly down to manslaughter for a plea deal and that's like nothing in terms of prison time.

There's a video out there that cuts off right after the warning shots are fired. The shooter was never in any danger and could have walked away to his car at any time. This dude is fucked, I guess slightly less fucked than the victim.

Unfortunately I've been on the wrong end of gun(s) being pulled a few times in civilian situations and it's freaking scary, like an electric shock goes through your body and you gotta decide quick how to handle the situation. But I wouldn't under any circumstances have continued attacking anyone unarmed myself once a gun's pulled, much less shots fired.

Wonder if the bartender was geeked up on anything. I'm sure the defense will pull the toxicology and if there's anything make it an issue in plea negotiations or if it goes to trial.

it is a pretty smart plan. Back when I worked midnights in a factory there was a bar just down the street that was open at like 6am. They had a great breakfast and plenty of drinks on tap. Guys would go in there and spend a bunch of money. I only went occasionally because I was always so tired I wanted sleep more than anything but lots of guys would go hang out until like 9 or 10am before heading home to sleep for a few hours.
