Im not going to doubt was shakes is saying but if the freezer had an inside release and a person is too fucked up, stupid, etc to figure out how to use it to free themselves ( I'm guessing its not real complicated) I mean, at what point is the person who got themselves into the predicament at fault?

It's crazy. I deal with a bit of liability cases, so shakes would know way more, but there are different levels of duties owed to different parties, even if that party is a tresspasser, as shakes alluded to. Depending on the state, they could be found to be only a percentage responsible (contributory negligence), but that percentage could still be a ton of money with someone's life. I would imagine the argument would go something like...

- Hotel has a duty to lock all freezers to prevent any guests from entering

- Hotel did not

- Guest enters

- The hotel failing to lock their freezers contributed to her death

Exactly -- hotel has an obligation to restrict entrance to closed areas, etc. They can put the hotel's role in her death at 10% and then have some sort of a payout for that. Presumably the real issue is who let her drink/gave her drugs/drugged her to the point of this wandering stupor. If they charge drug dealers for manslaughter when their buyers die from their product, they can work up a similar charge to some of those at the party.

The lighting is interesting. I installed the wiring for a cooler and a freezer last week. The light switch for the cooler was in the inside due to convenience. The freezer has 2 doors so it just had 3 way switches at the outside of each door. Now there were door switches that would open or close as the door opened and you could have that trigger the lights either way. I would just leave the things on 24-7.

Except Illinois is a 50% Modified Comparative Negligence Venue technically meaning the defendant, the hotel, would need to be at least 50% liable for fault to be found. As others have said, though, they or their insurance carrier would likely offer a settlement before getting to that point. I am a liability claims examiner and in uber liberal Cook county, most defendants settle instead of chancing it with a jury verdict.

There will definitely be some comparative fault on Frosty's end, but in the end the hotel has a duty to keep its premises safe from hazards. If Frosty can wander aimlessly and hammered through the hotel and somehow find her way into an abandoned and unlocked freezer that's a serious problem with the hotel. Hotel is well aware that they have a lot of inebriated guests and visitors on their premises and have a duty to make sure its not possible for something like that to happen.

Additionally the fact that the mom was at the hotel Saturday morning pounding on doors looking for her daughter and the hotel responded by calling 911 on her is not going to look good at all, especially if it can be determined that the daughter might've still been alive at that point.

They could be self-insured up to a certain amount. Large companies and corporations often are. Then they would be paying likely some or all of any potential settlement.

I've never done ecstasy or any man-made drugs, but I have been out at the clubs when others were, and the prevailing theme is that the body overheats greatly, and they feel a compelling need to drink loads and loads of water and juice.

Agreed - she probably was feeling ultra hot due to the drugs and enjoyed the relief of the cool freezer so much she passed out. End of story.
