Yep, my former employer had three different in-house marriages. One was a Board member and a project manager, the other two were both sets of peers working together on projects where one still would have nominal rank over the other. The first one caused a bit of a kerfluffle and the new wife left, the other two were really seamless because they went to HR and their bosses and they worked things out in terms of keeping things transparent.

I'm not sure if it was an affair. Either way, to me, it should be irrelevant to HR (assuming the victim wife/husband doesn't also work at the company). HR does not know/should not know about the health of your marriage, if you're formally/informally seperated or not, etc. They just typically know you're married (through tax forms you may file, etc.)

So, even if you were to disclose to HR that you're dating someone, and they have it on record that you're married, I can't see how the knowledge of you being legally married would be relevant, assuming HR is also not playing the role of morality enforcement. Curious as to what the board lawyers might say.
